Terms of Service

These terms govern your use of DSS WhatsApp, operated by Dynamic Software Solution, Karachi, Pakistan (“we”). By creating an account you agree to them.
What the service is
DSS WhatsApp is a platform for sending and receiving messages through the official WhatsApp Business Cloud API operated by Meta. We provide the team inbox, contact management, message templates, campaigns and automation. Meta delivers the messages.
We act as a technology provider. You connect your own WhatsApp Business Account and pay Meta directly for message delivery. We do not resell messages and do not mark them up. Your subscription with us covers the software only.
Your account
- You must give accurate details and keep your password secure.
- You are responsible for everything done under your account, including by your team.
- Owners and admins can invite and remove members. Removing someone ends their access immediately.
- You must be legally able to enter a contract in your country.
Your responsibilities when messaging
WhatsApp is unusually strict about consent, and the consequences of ignoring that fall on your number, not ours. You agree that:
- You have opt-in consent from every person you message, obtained before you message them, and you can evidence it.
- You honour opt-outs promptly. The platform detects common unsubscribe keywords, but the obligation is yours.
- You comply with the WhatsApp Business Messaging Policy, Meta’s Commerce Policy, and the law wherever your recipients are.
- You do not send spam, scams, malware, or content that is unlawful, hateful, or harassing.
- You do not use the service for prohibited categories under WhatsApp’s policies.
If Meta restricts, throttles or bans your phone number or WhatsApp Business Account as a result of how you use it, that is between you and Meta. We will help you understand what happened, but we cannot reverse it.
Acceptable use of the platform
Do not attempt to access other customers’ data, probe or overload the infrastructure, reverse-engineer the service, or resell access without a written agreement with us.
Fees
- Subscription fees are stated at checkout and billed in advance.
- A 14-day trial is available without a card. Unless you subscribe, access ends when it expires.
- You can cancel at any time. Cancellation takes effect at the end of the paid period; we do not refund part-months unless the law requires it.
- If a payment fails we will contact you and restrict features before removing anything. We do not delete your data because of a failed payment.
- Message charges from Meta are billed to you by Meta, separately from us.
Your data
Your contacts and messages remain yours. We process them to run the service, as described in our Privacy Policy. You can export them at any time and delete them as described on our data deletion page.
Availability
We aim for high availability but do not promise uninterrupted service on current plans. Maintenance, Meta outages, and problems at our providers can interrupt it. We are not liable for downtime originating with Meta or another upstream provider.
Suspension and termination
We may suspend or close an account that breaches these terms, puts other customers at risk, or is used unlawfully. Where circumstances allow we will warn you first and give you a chance to fix the problem. You may close your account at any time.
After closure we retain your data for 30 days so an accidental closure can be reversed, then delete it.
Liability
The service is provided “as is”. To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the three months before it arose, and we are not liable for lost profits, lost business or indirect loss.
Nothing here limits liability that cannot lawfully be limited.
Changes
We may update these terms. Material changes are emailed to account owners at least 14 days before they take effect. Continuing to use the service afterwards means you accept them.
Governing law
These terms are governed by the laws of Pakistan, and the courts of Karachi have exclusive jurisdiction.
